1. PURPOSE  

This policy establishes the procedures and requirements for both initial certification testing and ongoing periodic testing of children’s bicycles to ensure compliance with all applicable federal and state safety regulations, including CPSIA requirements and applicable provisions of 16 CFR Parts 1512, 1303, 1307, 1107, and 1109, as well as relevant state regulations.

2. SCOPE  

This policy applies to all children’s bicycles manufactured, imported, or distributed by J&B Importers Inc. that are subject to certification under the Consumer Product Safety Improvement Act (CPSIA).

3. COMPLIANCE FRAMEWORK  

J&B Importers, Inc. conducts periodic testing in accordance with 16 CFR §1107.21(b). All periodic testing is performed by a CPSC-accepted third-party conformity assessment body.

Testing requirements are determined based on applicable federal regulations, state laws, and product-specific risk factors.

4. APPLICABLE TESTING REQUIREMENTS  

Children’s bicycles are evaluated to ensure compliance with all applicable mechanical, chemical, and regulatory requirements. Testing is categorized as follows:

A. Mechanical and Performance Safety (CPSC)  

Testing is conducted to verify that bicycles are safe for intended use and comply with applicable performance and construction requirements, including:

• 16 CFR Part 1512 – Requirements for Bicycles

B. Chemical and Material Safety (CPSIA)  

Testing is conducted to ensure that materials used in children’s bicycles are safe for exposure and comply with CPSIA requirements, including:

• 16 CFR Part 1303 – Lead in Paint and Surface Coatings  
• CPSIA Section 101 / 16 CFR §1500.87 – Lead content in accessible substrates (and other heavy metals where applicable)  
• 16 CFR Part 1307 – Phthalates in plasticized components  

C. State and Additional Regulatory Requirements  

Where applicable, testing is conducted to meet additional state-level and customer-driven requirements, including:

• California Proposition 65 – Chemical exposure requirements (including phthalates and other listed substances)  
• U.S. State Regulations (including Maine, Oregon, Vermont, and Washington) – Phthalates and priority chemicals  
• Bisphenol-A (BPA) content  
• PFAS screening (commonly expressed as total fluorine content)

D. Test Methodology  

All testing is conducted by a CPSC-accepted third-party conformity assessment body using applicable regulatory test methods and recognized industry standards.

E. Component Part Testing  

Component part testing may be used, where appropriate, in accordance with 16 CFR Part 1109 to support certification and periodic testing requirements.

5. PERIODIC TESTING PLAN  

A periodic testing plan is maintained for each children’s bicycle model at each manufacturing site. The plan is managed digitally and communicated to manufacturing partners through J&B’s internal systems and supplier-facing resources.

Each plan includes

• Identification of applicable safety regulations  
• Specific tests to be conducted  
• Testing intervals  
• Number of samples to be tested  
• Methodology for selecting representative samples  

The testing plan is designed to provide a high degree of assurance that products manufactured after certification, or since the last periodic test, continue to comply with all applicable safety requirements. Manufacturing partners are expected to follow these requirements as part of their ongoing production responsibilities.

6. TESTING INTERVAL  

Periodic testing is conducted at intervals not exceeding one (1) year, in accordance with 16 CFR §1107.21(b).

Testing intervals may be adjusted to shorter periods based on risk factors, including:

• Variability in prior test results  
• Proximity to regulatory limits  
• Changes in materials, components, or suppliers  
• Manufacturing process changes  
• Production volume  
• Consumer complaints or warranty claims  
• Severity of potential injury associated with noncompliance  

7. SAMPLE SELECTION  

Representative product samples are selected to support compliance across all units produced during the testing interval. 

J&B Importers, Inc. obtains pre-production samples from the manufacturing site at least once every twelve (12) months for third-party testing. These samples are intended to represent current production specifications, materials, and processes.

8. DOCUMENTATION AND RECORDKEEPING  

J&B Importers Inc. maintains records of:

• Periodic testing plans  
• Test reports and Children’s Product Certificates (CPCs)  
• Sample selection procedures  
• Manufacturing site information  
• Corrective actions, if applicable  

Records are retained in accordance with applicable regulatory requirements and internal document retention policies.

9. CORRECTIVE ACTION  

If any product fails to comply with applicable safety requirements:

• Immediate investigation will be initiated  
• Production and distribution may be suspended if necessary  
• Root cause analysis will be conducted  
• Corrective actions will be implemented and documented  
• Retesting will be performed prior to continued distribution  

10. CONTINUOUS REVIEW  

This policy and associated testing plans are reviewed periodically and updated as necessary to reflect changes in regulations, product design, or manufacturing processes.

11. RESPONSIBILITY  

J&B Management is responsible for Implementation and oversight of this policy, in coordination with third-party testing laboratories and manufacturing partners. These parties work collaboratively to ensure compliance with all applicable safety requirements.
