Adult Bicycle, Tricycle, & Recumbent Testing Policy

1. PURPOSE  

This policy establishes the procedures and requirements for testing adult bicycles, tricycles, and recumbents (two- and three-wheeled, non-motorized), including initial evaluation and ongoing verification, to ensure compliance with all applicable federal and state safety regulations, including 16 CFR Part 1512, ANSI Z315.1, and relevant state requirements.


2. SCOPE  

This policy applies to all standard adult bicycles, tricycles, and recumbents (two- and three-wheeled, non-motorized) manufactured, imported, or distributed by J&B Importers, Inc., and is intended to ensure compliance with applicable federal and state safety regulations.


3. COMPLIANCE FRAMEWORK  

J&B Importers, Inc. ensures that all adult bicycles, tricycles, and recumbents comply with applicable federal safety requirements, including 16 CFR Part 1512 and ANSI Z315.1. Adult bicycles, tricycles, and recumbents are not subject to CPSIA third-party testing or certification requirements.

Testing and evaluation activities are determined based on applicable regulations, state laws, and product-specific risk factors, and may be conducted in coordination with manufacturing partners and third-party laboratories, including accredited laboratories where appropriate.


4. APPLICABLE TESTING REQUIREMENTS  

Adult bicycles, tricycles, and recumbents are evaluated to ensure compliance with applicable mechanical safety requirements and relevant state regulations. Requirements are categorized as follows:

A. Mechanical and Performance Safety (CPSC)  

Bicycles, tricycles, and recumbents are evaluated to verify they are safe for intended use and comply with applicable performance and construction requirements, including:

B. State and Additional Regulatory Requirements  

J&B Importers, Inc. addresses applicable state-level chemical regulations through a combination of supplier information, product evaluation, limited screening, regulatory monitoring, and the use of consumer warnings where appropriate.

This includes:

  • California Proposition 65 – Products are labeled with appropriate warnings where required  
  • U.S. State Regulations (including Maine, Oregon, Vermont, and Washington) – Evaluation of applicable requirements related to phthalates, priority chemicals, and reporting obligations, where applicable  
  • Bisphenol-A (BPA) – Considered as part of material and regulatory evaluation, where applicable  
  • PFAS – Limited screening may be conducted (commonly expressed as total fluorine content)  

The following warning is applied to products where required:

"WARNING: This product can expose you to chemicals including Lead, DEHP, DINP, and BPA, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov."

C. Test Methodology  

Testing and evaluation activities are conducted using appropriate methods and may be performed in coordination with third-party testing laboratories and manufacturing partners. Accredited laboratories may be utilized, where appropriate, to support compliance verification.

D. Component Evaluation  

Component-level evaluation and supplier-provided data may be used, where appropriate, to support compliance with applicable regulatory requirements.


5. TESTING APPROACH  

Testing and evaluation activities are conducted for adult bicycles, tricycles, and recumbents based on applicable regulatory requirements and product-specific risk factors.

J&B Importers, Inc. manages these activities digitally and communicates expectations to manufacturing partners through internal systems and supplier-facing resources.

Testing and evaluation may include:

  • Identification of applicable safety regulations  
  • Verification of compliance with 16 CFR Part 1512 and ANSI Z315.1 
  • Evaluation of product design, materials, and components  
  • Selection of representative samples, where appropriate  
  • Coordination with third-party laboratories, as needed  

Manufacturing partners are expected to support these activities and ensure that products are produced in accordance with applicable safety requirements and approved specifications.


6. TESTING FREQUENCY  

Testing and evaluation of adult bicycles, tricycles, and recumbents are conducted as needed based on product-specific risk factors and business requirements, rather than at fixed regulatory intervals.

Testing frequency may be increased based on factors including:

  • Variability in prior test results  
  • Proximity to regulatory limits  
  • Changes in materials, components, or suppliers  
  • Manufacturing process changes  
  • Production volume  
  • Consumer complaints or warranty claims  
  • Severity of potential injury associated with noncompliance  


7. SAMPLE SELECTION  

Representative product samples may be selected, as appropriate, to support evaluation of compliance with applicable safety requirements.

J&B Importers, Inc. may obtain pre-production samples from the manufacturing site to verify compliance with current production specifications, materials, and processes. Sample selection and testing are conducted based on product-specific considerations and risk factors.


8. DOCUMENTATION AND RECORDKEEPING  

J&B Importers, Inc. maintains records to support compliance with applicable safety requirements, including:

  • Test reports and evaluation records  
  • Product specifications and design documentation
  • Sample selection and evaluation procedures, where applicable
  • Manufacturing site information  
  • Corrective actions, if applicable  

Records are retained in accordance with applicable regulatory requirements and internal document retention policies.


9. CORRECTIVE ACTION  

If any product fails to comply with applicable safety requirements:

  • Immediate investigation will be initiated  
  • Production and distribution may be suspended if necessary  
  • Root cause analysis will be conducted  
  • Corrective actions will be implemented and documented  
  • Retesting may be performed prior to continued distribution  


10. CONTINUOUS REVIEW  

This policy and associated testing activities are reviewed periodically and updated as necessary to reflect changes in regulations, product design, or manufacturing processes.


11. RESPONSIBILITY  

J&B Management is responsible for implementation and oversight of this policy, in coordination with third-party testing laboratories and manufacturing partners. These parties work collaboratively to ensure compliance with all applicable safety requirements.
